1. Introduction

These Customer Terms (“Terms”) govern your use of the MYCRANE DMCC auction platform (“Platform”) for posting crane rental requirements. By posting an auction request, you (“Customer”) agree to be bound by these Terms, our General Terms & Conditions, and our Privacy Policy. If you do not agree with these Terms, you must not use the Platform.

2. Platform Role

• MYCRANE DMCC provides a digital platform for Customers to receive competitive offers from crane suppliers.
• We do not own, rent, supply, or operate cranes.
• We are not a party to any rental contract entered between you and any supplier.
• We do not guarantee the availability, quality, or pricing of cranes or suppliers listed.

3. Eligibility to Use the Platform

To use the Platform, you must:

• Be a business or individual with legal authority to request crane rental services.
• Create an account and submit accurate contact, company, and project details.
• Agree to follow all applicable laws and safety regulations related to crane use.

4. Posting a Crane Requirement (Auction Request)

When posting your requirement on the Platform, you agree to provide:

• Crane capacity and type (e.g., crawler, hydraulic, telescopic, etc.).
• Duration of rental (start/end dates and shift details).
• Site location, access details, and job conditions.
• Scope of work (mobilization, demobilization, operator, fuel, etc.).
• Any technical requirements or compliance documents.
• Whether the quote should be all-inclusive or component-wise (e.g., rental + mobilization).

Once posted, this will be visible to verified crane suppliers for bidding.

5. Auction Process

• Suppliers will submit price offers within the timeline you define.
• You are under no obligation to accept any bid.
• You may select the best offer based on price, availability, brand, or other criteria.
• You may cancel or revise the auction at any time before awarding, without liability.

6. Award and Supplier Engagement

• Once you select a supplier’s offer, you are encouraged to formalize a Crane Rental Agreement directly with the supplier.
• All scope, terms, safety, insurance, and payments must be confirmed directly between you and the supplier.
• MYCRANE DMCC does not take part in negotiations, contract enforcement, or invoicing.

7. Customer Responsibilities

As a Customer, you agree to:

• Not post fake or misleading crane requirements.
• Not conduct direct deals with suppliers outside the platform during an active auction.
• Evaluate bids in good faith and notify MYCRANE DMCC of the outcome.
• Provide correct contact and site information to shortlisted suppliers.
• Maintain professional conduct in all communication.

8. Communication and Confidentiality

• Your auction details may be shared with verified suppliers participating in that specific auction.
• You may use the platform or email/phone to coordinate with bidders.
• You must not misuse supplier data or quotations for personal or competitive advantage outside the scope of the posted project.

9. No Obligation to Award

You are not bound to award any auction. However:

• Repeated posting and cancellation of auctions without valid cause may result in account suspension.
• MYCRANE DMCC reserves the right to monitor auction quality and usage patterns.

10. Limitation of Liability

• MYCRANE DMCC shall not be liable for the accuracy or performance of any crane or supplier.
• We are not liable for delays, disputes, damages, or losses resulting from your contract with a supplier.
• We have no liability whatsoever for site conditions, accidents, or regulatory issues, as MYCRANE DMCC acts solely as a neutral platform facilitator.

11. Indemnity

You agree to indemnify MYCRANE DMCC against any claims, losses, or damages arising from your use of the Platform, disputes with suppliers, or breach of these Terms.

12. Governing Law

These Terms shall be governed by the laws of the country:

• In which you (the Customer) reside, or
• In which the crane rental project is executed.

You agree that all disputes will be subject to the jurisdiction of that location’s courts.

13. Changes to These Terms

MYCRANE DMCC may update these Terms at any time. Revised Terms will be published on the Platform. Continued use after changes implies your acceptance.
